Supreme Court overturns federal Eviction Moratorium

The Supreme Court has overturned a federal eviction moratorium issued by the Centers for Disease Control and Prevention.

The CDC issued the moratorium to limit the spread of COVID-19.

The Supreme Court ruled a federal statute, which grants powers to the CDC to prevent the spread of disease, doesn’t allow the agency to authorize an eviction moratorium on its own.

The three liberals on the court disagreed, and joined a dissent written by Justice Breyer.

The Supreme Court issued the decision on its “shadow docket,” which allows the court to consider  emergency motions and other expedited cases that haven’t received full briefing or oral argument.
